ELIGIBILITY:  Sweepstakes is open only to legal adult residents of the 50 United States (including District of Columbia), 18 years of age or older (or age of majority in state of residence) at time of entry. Employees of TruGreen Limited Partnership (“TruGreen,” “Sponsor”),  JNR Incorporated, GMR Marketing LLC (“GMR”), and their respective parent companies, affiliates, sales representatives, distributors, and vendors involved with this promotion, and participating retail outlets, and the immediate family and household members of all such employees, are not eligible to enter or win. Sweepstakes is subject to all federal, state and local laws and regulations. Entrants will be given the option to receive future communication via e-mail from TruGreen and its promotional partners, however, eligibility to participate in the Sweepstakes is not dependent on entrant’s consent to receive such e-mails.  TruGreen and its promotional partners, agencies and vendors are not responsible for lost, late, incomplete, inaccurate, misdirected, unintelligible or returned entries.

HOW TO ENTER: There are two ways to enter the “The TruStories Sweepstakes”: (1) Online: Visit www.trugreen.com/sweepstakes and complete the online entry form, including your name, full address, day and evening phone and e-mail address. You will be required to accept the official rules prior to submitting your entry (which you will have the opportunity to review). (2) Mail: Print your name, full address, daytime and evening phone numbers, age, e-mail address and “The TruStories Sweepstakes” on a 3”x5” card and mail to: “The TruStories Sweepstakes”, P.O. Box 511215, New Berlin, WI 53151 or “The TruStories Sweepstakes”, P.O. Box 511425, New Berlin, WI 53151.

TIMING/ENTRY LIMITS: The Sweepstakes begins at 12:01 am Eastern Time (“ET”) on January 24, 2011 and ends at 11:59 pm ET on October 16, 2011 (the “Promotion Period”). Limit two (2) entries per household, one (1) via online method and one (1) via mail. All mail-in entries must be postmarked by October 16, 2011 and received by October 24, 2011.  Any person attempting to submit multiple entries that exceed the entry limits will be ineligible to participate or to receive a prize. 

GRAND AND FIRST PRIZE DRAWING: Grand and First Prize drawings will be held on or about October 26, 2011 from among all eligible online, mail and Bonus entries received. See details on Bonus Entry Opportunities below.

WEEKLY PRIZE DRAWING: In addition to the Grand and First Prize drawing, there will be thirty-eight (38) prizes awarded on a weekly basis. One (1) Weekly Prize, a $250 pre-paid Reward MasterCard®, will be awarded each week during the Promotion Period. Online and mail entries must be received by 11:59 pm on the Entry Deadline date (see figure 1 below) to be included in that week’s drawing. Weekly prize drawings will be conducted on the Friday following each entry deadline. Entries will roll-over to subsequent Weekly Prize drawings. Bonus entries as described in the “Bonus Entry Opportunities” section below will not be eligible for Weekly Prize Drawings.

All drawings will be conducted in accordance with these Official Rules on Sponsor’s behalf by GMR, an independent judging organization whose decision on all matters related to the Sweepstakes are binding and final. Odds of winning depend on the number of eligible entries received.

BONUS ENTRY OPPORTUNITIES: You may earn Bonus Entries in two ways: (1) Obtaining a free, no-obligation lawn care quote (new customers) or receiving additional information on TruGreen products and services (existing customers) and (2) Telling-a-Friend via e-mail. Bonus Entries are eligible only for the Grand and First Prize drawings; they are not eligible for Weekly Prize drawings. See details below.

Lawn Care Quote or Additional Information on TruGreen products and services:  You may receive ten (10) bonus entries by agreeing to a free, no-obligation lawn care quote, either by being contacted by a TruGreen representative or by requesting additional information on TruGreen products and services. Limit one (1) quote per household during the Promotion Period. Upon receiving the quote, you will receive ten (10) bonus entries into the Grand and First Prize Drawing.  To obtain 10 bonus entries without obtaining a quote, print your name, full address, day and evening phone numbers, age and e-mail address and “The TruStories Sweepstakes” Quote Bonus Entry on a 3”x5” card and mail it to: “The TruStories Sweepstakes” Quote, P.O. 2. Tell-A-Friend: You may receive up to ten (10) bonus entries by emailing friends/family about the Sweepstakes during the Promotion Period.  During the online registration process, you will be invited to email up to ten (10) friends/family who would be interested in receiving information from TruGreen. You will be required to initiate the email to each friend/family, and use email text provided by Sponsor that will include an invitation to participate in the “The TruStories Sweepstakes” as well as an opt-in to receive information from TruGreen. You will receive one (1) bonus entry for each valid and confirmed email address, maximum ten (10) per entrant.  To obtain 10 bonus entries without a Tell-A-Friend obligation, print your name, address, daytime and evening phone numbers, age and e-mail address and “The TruStories Sweepstakes” Tell-a-Friend Bonus Entry on a 3”x5” card and mail it to: “The TruStories Sweepstakes” Tell-a-Friend Bonus,  P.O. The maximum number of Bonus Entries per household is 20, comprising a maximum of 10 for the lawn care quote/additional information feature and 10 for the tell-a-friend feature (or respective mail-in opportunities).

PRIZES AND APPROXIMATE RETAIL VALUES: One (1) Grand Prize: $25,000 MasterCard Reward Card.  MasterCard Reward Cards are subject to state and federal regulations, and may be used anywhere Debit MasterCard is accepted.  Cards will be issued with a one year expiration date, from the date of issuance.  The MasterCard Reward Card cannot be used for cash access at ATMs or bank tellers. Sponsor will also present the Grand Prize winner with a single cash “gross-up” payment of $12,878.79 which is intended to help defray the cost of the taxes related to the Grand Prize.

Total Approximate Retail Value of Grand Prize, including the gross-up payment, is $ 37,878.79.

Fifty (50) First Prizes, each a $500 MasterCard Reward Card.  MasterCard Reward Cards are subject to state and federal regulations, and may be used anywhere Debit MasterCard is accepted.  Cards will be issued with a one year expiration date, from the date of issuance. The MasterCard Reward Card cannot be used for cash access at ATMs or bank tellers.

Thirty-eight (38) Weekly Prizes: each a $250 MasterCard Reward Card.  MasterCard Reward Cards are subject to state and federal regulations, and may be used anywhere Debit MasterCard is accepted.  Cards will be issued with a one year expiration date, from the date of issuance. The MasterCard Reward Card cannot be used for cash access at ATMs or bank tellers.

Total ARV of all prizes to be awarded is $72,378.79.

Taxes on a prize are the sole responsibility of the winner. Prizes are non-transferable and no substitution or cash equivalent is allowed except in Sponsor’s sole discretion.  Sponsor reserves the right to substitute prizes of the same approximate retail value.  Prize consists only of items specifically listed as part of the prize. Certain conditions and restrictions may apply. All costs and expenses not specified herein, related to any prize, incurred by accepting the prize are the sole responsibility of the Winner.  Odds of winning depend on the number of eligible entries received.

WINNERS: Potential Grand and First Prize winners will be selected in a random drawing on or about October 26, 2011. Potential Grand Prize winners will be notified by phone, overnight express delivery, or mail to the number/address indicated on the entry (at TruGreen’s discretion) on or about five (5) business days following drawing date.  If any notification or prize is returned as undeliverable, original winner will forfeit prize in its entirety and an alternate winner will be selected.  Potential Grand Prize winners will be required to sign an affidavit of eligibility, mutually-acceptable liability release, publicity release, and any other necessary documents, including personal services agreement, assignment of rights and required tax documents within five (5) calendar days after notice is received or the prize will be forfeited in its entirety and an alternate winner will be selected.  Award of prizes and confirmation of winners is contingent upon potential winner’s qualification and compliance with all Official Rules.  Alternate winners, if needed, will be selected in a similar random drawing from among the remaining eligible entries.  Weekly Prizes will be shipped approximately 4-6 weeks following Weekly Prize drawings. Grand and First Prizes will be shipped approximately 4-6 weeks after the conclusion of the Sweepstakes.  

PUBLICITY RELEASE:  Except where prohibited, acceptance of a prize constitutes winner’s consent that their name, likeness, voice and/or biographical data may be used in any medium for advertising and promotional purposes without limitation and without additional notice, compensation or consent. 

REGISTRATION: If for any reason the Sweepstakes, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual Sponsor or GMR deems responsible and Sponsor further reserves the right to cancel, terminate, modify or suspend the Sweepstakes, and substitute an appropriate alternate method of prize award selection.  Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize.   Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes.  WARNING:  ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  Sweepstakes entries generated by a script, macro or other mechanical or automated means are ineligible and will be disqualified.  All entries must include a valid e-mail address for the entrant.  In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of the entry.  The “Authorized Account Holder” is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.

RELEASE OF LIABILITY: By entering, entrant agrees to accept and abide by the rules of this Sweepstakes and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation or award of prize, shall be resolved by GMR, whose decision shall be binding and final.  By participating, entrant agrees to release and hold harmless TruGreen, JNR Incorporated, GMR, promotional retail partners and each of their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations from any injury, loss or damage to person, including but not limited to death or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of a prize, participation in any Sweepstakes-related activity, or participation in the Sweepstakes.  Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Sweepstakes or in the announcement of prizes, including such error as may give an erroneous indication that a prize has been won.  In the event the Sponsor is prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event), the Sponsor shall have the right, in its  sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation.  If the Sponsor, in its discretion, elects to abbreviate the Sweepstakes as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event.  All entries are the property of the Sponsor and are not returnable.
